fractionnement du revenu offertes aux Canadiens, qui ne contrevient pas aux diverses \u00ab r\u00e8gles d\u2019attribution \u00bb de la <i>Loi de l\u2019imp\u00f4t sur le revenu<\/i> <em>(Canada)<\/em>.<\/li><li class=\"translation-block\">Une strat\u00e9gie de pr\u00eat \u00e0 taux prescrit permet aux Canadiens de pr\u00eater l\u00e9gitimement du capital, ainsi que de placer les revenus et les gains d\u00e9coulant du pr\u00eat \u00e0 leur \u00e9poux ou conjoint de fait ou bien \u00e0 une fiducie <i> entre vifs, <\/i>tandis que les b\u00e9n\u00e9ficiaires paient de l\u2019imp\u00f4t \u00e0 des taux marginaux moindres. The accrued interest for the period December 1 &#8211; 31 must be calculated and paid no later than January 30, 2025.<\/li><li>A $2 million prescribed rate loan at 5% interest was set up on July 1, 2024, half the loan principal ($1 million) was repaid on December 15, 2024. Interest for 2024 will be calculated as 5% on $2 million (July 1 &#8211; December 14) plus 5% on $1 million (December 15 &#8211; 31). The loan will be considered \u201ctainted\u201d.<\/p><p>M\u00eame si un nouveau pr\u00eat \u00e0 taux prescrit peut \u00eatre \u00e9tabli de fa\u00e7on \u00e0 r\u00e9cup\u00e9rer les avantages fiscaux, il peut y avoir plusieurs cons\u00e9quences n\u00e9gatives lorsque les int\u00e9r\u00eats ne sont pas pay\u00e9s \u00e0 temps.<\/p><ul><li><strong>Professional Fees<\/strong><\/li><\/ul><p style=\"padding-left: 40px;\">Establishing a prescribed rate loan generally comes with professional fees. For example, a lawyer would have to be engaged to draft a new loan agreement to document the new prescribed rate loan.<\/p><p style=\"padding-left: 40px;\">Additionally, professional fees from accountants and\/or tax advisors may also be required.<\/p><ul><li><strong>Lost Access to Lower Interest Rates<\/strong><\/li><\/ul><p style=\"padding-left: 40px;\">Though they have begun coming down, prescribed rates rose sharply starting mid-2022. The prescribed rate has been set at 4% for the first quarter of 2025.<\/p><p style=\"padding-left: 40px;\">Given the interest rate is \u201clocked in\u201d at the time a prescribed rate loan is established, missing an interest payment may taint a prescribed rate loan that is locked in at a lower interest rate (many have been established at 1%). Generally, the lower the prescribed rate attached to the loan, the greater the tax benefits.<\/p><ul><li><strong>Liquidation of Portfolio<\/strong><\/li><\/ul><p style=\"padding-left: 40px;\">Where the prescribed rate loan was used by the borrower to purchase marketable securities, it is generally best practice to liquidate the portfolio, settle the \u201ctainted\u201d prescribed rate loan, establish a new prescribed rate loan and invest.
